These Terms and Conditions govern your use of destii.com.au and any purchase you make from DESTii.

By accessing our website, creating an account or placing an order, you agree to these Terms and Conditions, together with our:

• Privacy Policy
• Shipping Policy
• Returns + Refund Policy
• Any other policy or notice displayed on the website

References to “DESTii”, “we”, “us” and “our” mean DESTii. References to “you” and “your” mean the person accessing the website or purchasing from us.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

1. Eligibility to use the website

You may use this website only for lawful purposes.

By placing an order, you confirm that:

• You are at least 18 years old, or have permission from a parent or legal guardian
• The information you provide is complete and accurate
• You are authorised to use the payment method selected
• You are purchasing for personal use unless we have agreed otherwise

You must not use the website in a way that could damage, disrupt or compromise its operation or security.

2. Product information

We take reasonable care to ensure product descriptions, photographs, measurements, prices and availability are accurate.

However:

• Colours may appear differently depending on your screen and device
• Linen is a natural material and may display minor variations in texture, weave, colour and slubbing
• Measurements may vary slightly due to the nature of garment production and fabric
• Product packaging may change from time to time
• Availability may change without notice

Natural variations that are inherent to linen are not necessarily defects.

Nothing in this section limits your rights where a product fails to meet a consumer guarantee under the Australian Consumer Law.

3. Prices and currency

Unless otherwise stated:

• Prices displayed on the Australian website are in Australian dollars
• Prices include GST where applicable
• Delivery charges, duties and taxes may be additional
• The total payable will be shown at checkout before you confirm your order

We may change product prices and promotions at any time. Any change will not affect an order that we have already accepted, except where there has been an obvious error.

Promotional offers may be subject to additional conditions displayed at the time of the promotion.

4. Placing an order

Submitting an order is an offer to purchase the selected products under these Terms.

After you submit an order, you will usually receive an automated confirmation email. This confirms that we have received your order but does not necessarily mean that the order has been accepted.

An order is accepted when we:

• Dispatch the products; or
• Otherwise confirm acceptance to you

We may contact you before accepting an order if additional information or verification is required.

5. Order refusal or cancellation

We may refuse or cancel an order where reasonably necessary, including where:

• A product is unavailable
• There is an obvious pricing or product-description error
• Payment cannot be authorised
• We reasonably suspect fraud or unauthorised activity
• Purchase limits have been exceeded
• An order appears to be for unauthorised resale
• We cannot deliver to the nominated address
• The order breaches these Terms or applicable law

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

We will not cancel an accepted order merely because we later decide that the agreed price was commercially unfavourable.

6. Pricing or website errors

Occasionally, the website may contain an obvious error relating to pricing, availability, promotions, delivery charges or product information.

Where we identify an obvious error before accepting an order, we may:

• Correct the information
• Contact you to confirm whether you wish to proceed at the correct price
• Cancel the affected order and issue a refund

Where an error is not obvious, or the order has already been accepted, your rights will depend on the circumstances and applicable law.

We will not use this clause to avoid obligations under the Australian Consumer Law.

7. Payment

Payment must be made using one of the methods offered at checkout.

Payment services may be provided by third parties, such as:

• Shopify Payments
• Credit-card providers
• PayPal
• Buy-now-pay-later providers
• Other payment processors made available at checkout

Your use of a third-party payment service may also be subject to that provider’s terms.

You are responsible for ensuring that your payment and billing details are accurate.

8. Fraud prevention and verification

We may use fraud-screening and verification tools before accepting or dispatching an order.

Where reasonably necessary, we may request additional information to verify:

• Your identity
• The payment method
• The billing or delivery address
• The legitimacy of the transaction

We may delay, refuse or cancel an order if reasonable verification cannot be completed.

9. Shipping and delivery

Orders are processed and delivered in accordance with our Shipping Policy.

Delivery timeframes are estimates unless we expressly state otherwise.

You are responsible for:

• Providing an accurate and complete delivery address
• Monitoring tracking information
• Collecting parcels where required
• Ensuring the delivery location is reasonably secure

Risk in the products passes to you when the order is delivered to the address provided, subject to any rights that cannot lawfully be excluded.

Ownership of the products passes once we have received full payment.

10. International orders

International customers are responsible for ensuring that products can lawfully be imported into their destination country.

Orders may be subject to:

• Customs duties
• Import taxes
• Brokerage charges
• Local processing fees
• Customs inspections and delays

Unless expressly stated otherwise at checkout, these amounts are not included in the product price or delivery charge and are the customer’s responsibility.

11. Returns, exchanges and refunds

Change-of-mind returns, exchanges and refunds are governed by our Returns + Refund Policy.

That policy is in addition to any rights you may have under the Australian Consumer Law.

A product purchased on sale or marked Final Sale may still qualify for a remedy if it is faulty, unsafe, incorrectly described or otherwise fails to meet an applicable consumer guarantee. The ACCC has recently taken action over policies suggesting that clearance products or goods purchased using store credit could never qualify for a refund.

12. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances, you may be entitled to a repair, replacement, refund, compensation or another remedy where a product:

• Is faulty or unsafe
• Is not of acceptable quality
• Does not match its description
• Is not fit for a disclosed purpose
• Does not satisfy another applicable consumer guarantee

For a major problem, the customer generally has the right to choose a refund or replacement. For a minor problem, the supplier may generally choose to repair the product within a reasonable time.

Nothing in these Terms limits those rights.

13. Customer accounts

You may be able to create or access a customer account through the website.

You are responsible for:

• Keeping login details confidential
• Restricting access to your device and account
• Providing accurate account information
• Informing us promptly if you suspect unauthorised access

We may suspend or close an account where we reasonably believe it has been misused, compromised or used in breach of these Terms.

14. Discount codes, promotions and gift cards

Discounts, promotional codes and gift cards may be subject to additional conditions displayed when issued.

Unless stated otherwise:

• Discount codes cannot be exchanged for cash
• Only one discount code may be used per order
• Discount codes cannot be applied retrospectively
• Promotions may exclude selected products
• Promotions are available only during the stated period
• Gift cards may not be purchased using another gift card
• Lost or stolen gift cards may not be replaceable unless required by law

We may withdraw or correct a promotion where there is an obvious error, fraud, misuse or technical malfunction.

15. Reviews, photographs and other submissions

You may submit reviews, photographs, comments or other content to DESTii.

You retain ownership of content you create. However, by submitting content to us, you grant DESTii a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit, publish and display that content for:

• Operating the website
• Customer reviews
• Organic social media
• Internal training and customer service
• Other purposes reasonably connected with your submission

We will seek additional permission before using identifiable customer photographs or videos in paid advertising where appropriate.

You confirm that:

• You own the content or have permission to submit it
• The content is accurate to the best of your knowledge
• It does not infringe another person’s rights
• It is not unlawful, misleading, defamatory, abusive or malicious

We may moderate or remove content that breaches these requirements.

16. Intellectual property

The website and its contents—including branding, product names, photographs, graphics, designs, videos, copy, layout and software—are owned by or licensed to DESTii and are protected by intellectual-property laws.

You may view and use the website for personal, non-commercial purposes.

You must not, without prior written permission:

• Copy or reproduce substantial parts of the website
• Use DESTii branding or product imagery commercially
• Modify, distribute or republish website content
• Scrape or systematically extract website data
• Create derivative commercial works
• Misrepresent an affiliation with DESTii

17. Acceptable website use

You must not:

• Use the website unlawfully or fraudulently
• Interfere with its operation or security
• Upload malware or harmful code
• Attempt unauthorised access to any system or account
• Scrape or crawl the website in a way that places an unreasonable load on it
• Use automated tools to purchase products unfairly or bypass purchase limits
• Collect personal information about other users
• Infringe intellectual-property, privacy or other rights
• Submit false, abusive or misleading information

We may restrict access where reasonably necessary to protect the website, customers or DESTii.

18. Third-party services and links

The website may contain links to or integrations with third-party services.

DESTii does not control third-party websites and is not responsible for their:

• Availability
• Content
• Security
• Privacy practices
• Products or services

Your use of a third-party service is governed by that provider’s terms and policies.

This clause does not limit any responsibility we may have under applicable law for services we supply to you.

19. Website availability

We aim to keep the website available and accurate but do not guarantee uninterrupted or error-free access.

We may temporarily restrict access for:

• Maintenance
• Security
• Updates
• Technical issues
• Circumstances outside our reasonable control

Where practical, we will seek to minimise disruption.

20. Liability

To the maximum extent permitted by law, DESTii is not liable for loss caused by:

• Misuse of the website
• Unauthorised access caused by your failure to secure account credentials
• Third-party websites or services outside our reasonable control
• Events outside our reasonable control
• Loss that was not reasonably foreseeable

However, nothing in these Terms excludes or limits:

• Liability that cannot lawfully be excluded
• Rights under the Australian Consumer Law
• Liability arising from fraud or wilful misconduct
• Any remedy required by law

Where we are permitted to limit liability, our liability will be limited only to the extent that is fair, reasonable and lawful in the circumstances.

21. Indemnity

You are responsible for loss reasonably suffered by DESTii because of your unlawful use of the website, infringement of another person’s rights or material breach of these Terms.

This responsibility does not apply to the extent that the loss was caused or contributed to by DESTii.

This clause is intended to operate only to the extent permitted by law.

22. Events outside reasonable control

DESTii will not be responsible for delay or failure caused by circumstances outside our reasonable control, such as:

• Natural disasters
• Severe weather
• Fire or flood
• Industrial action
• Transport or carrier disruption
• War, civil unrest or government action
• Widespread internet or telecommunications outages
• Supply-chain disruption
• Public-health emergencies

Where such an event affects an order, we will take reasonable steps to communicate with you and provide an appropriate resolution.

23. Suspension and termination

We may suspend or terminate access to the website or a customer account where reasonably necessary because of:

• Fraud
• Security concerns
• Unlawful activity
• Material breach of these Terms
• Abuse of staff, customers or systems

Termination does not affect rights or obligations that arose before termination.

24. Changes to these Terms

We may update these Terms to reflect changes to:

• Our products or services
• The operation of the website
• Payment, delivery or technology providers
• Applicable law

The current version will be published on this page with the updated date.

Changes will apply prospectively and will not retrospectively alter an order already accepted unless required by law or agreed with you.

25. Severability

If any part of these Terms is found to be invalid or unenforceable, that part will be read down or removed to the minimum extent necessary.

The remaining Terms will continue to apply.

26. No waiver

If we do not immediately enforce a right under these Terms, that does not mean we have waived that right.

27. Entire agreement

These Terms, together with the policies incorporated by reference and any specific terms shown at checkout, form the agreement between you and DESTii in relation to your use of the website and purchases.

28. Governing law

These Terms are governed by the laws of New South Wales, Australia.

You and DESTii submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from them.

This does not prevent you from exercising rights available under the laws that apply to you as a consumer.
